In the modern era, attorney advertising has found its place in phone books, television and radio. With the amazing popularity and usage of internet as a source of communication, information and interaction, lawyers and law firms have their detailed information on the World Wide Web; the sites offer information and their specific areas of service. Of course, this has opened new avenues of opportunity, but at the same time, ignited new problems too.
Spamming
Way back in 1993, Laurence Canter and Martha A. Siegel, a law firm in Arizona, sent e-mail messages to a numerous internet new groups advertising their branch of specialty in practice ,in anticipation of prospective clients. These are (new groups) electronic notice boards which people use to post messages regarding some particular topic. They obviously have millions of subscribers all around the globe .In comparison with the conventional hard copy mailing; the direct mailing mechanism to the new groups practically cost them nothing. The process used in the method was spamming, this allows the message to be sent to one and all, irrespective of a group’s interest in the content of the message. The spamming paved way to a rush of protests from the readers of the new groups stating that spamming has despoiled the internet protocol.
Canter and Siegel’s received thousand of messages and some of them were threats to their life itself. At the same time they received approximately twenty thousand constructive responses and they were able to get some new prospective clients.
There were voices of protest from different corners at the spamming, but the advertisement from Canter and Siegel’s was very much legal. Their advertisement was comparable with a newspaper ad and they were under the assumption that people will go through the same.

The guidelines certainly have been helpful in bringing better standards in lawyer advertising, but numerous problems erupted in the course of time. The most significant problem is, as the guidelines are the conception of the American Bar Association, the implementation part has to be done by the legal profession. With any type of self regulation, this has invited some criticism from different corners, the opinion is that of the enforcement part, at times it is very careless and the insufficient penalty persuades other lawyers to engage in all sorts of malpractices.
The secondary problem is that, as the bar Association can form their own legislation based on the guidelines of The American Bar Association, the satisfactory lawyer marketing in one State will not be acceptable in the adjacent State. This may lead to perplexity and violation of ethics codes and credibility of the lawyer profession.
There were many notable judgments which have become milestones in today’s Lawyer Advertising arena. In 1977 Bar of Arizona, in a specific case related to Attorney Advertising, the Supreme Court ruled that
attorney advertising in newspapers is safeguarded by the first amendment and State professional or corrective codes cannot put an end to it. At the same time sensible restriction can be implemented on misleading and bogus advertisements.
